For note in the UK alone google has several hundred people are employed just looking at adsense fraud (friend works for the big G so I know this for a fact). I think using the same name will not make any harm just because there are many people that sharing the same name (first and last name) and it would be wrong for Google to ban a user who registers with Adsense for first time because of his name which previously used from a banned user.
