Well if you have a contract, you can argue that the terms of the contract weren't met, and thus you are entitled to a refund. However, since he is obviously unreliable, I am more than certain you likely don't have any contract. In which case, you could threaten to file a civil suit to get your money back (depending on how much is involved). But the best compromise would be to get a portion of your money back, since some part of the website has been delivered, that means he deserves some compensation.

It happens. Recently I experienced the same problem but in this case I am a developer. I gave her a full project two months back and now to send her an email is my daily duty. Evey morning I send her an email and begging for my own money. So you know its a problem for both buyers and sellers. Dont know whom to trust and whom to not. So forget that as I am gonna do. I know she will never pay me.
This is why escrow services are best when dealing with geographical distance and or "new" relationships are being established. This way the buyer has to put there money out there and the service provider has to finish the job so that they can get paid. Glad to hear you are getting your project done correctly!! Never pay your money upfront until the provider completes & makes the deliverable of the project to your satisfaction. There are too many rogue individuals (buyer and seller) out there these days. Some escrow services (i.e. Elance) will even charge you to arbitrate the dispute between the two you to get your money back from the provider if they do not perform the task or tasks as discuss between yourselves even if you have a contract with them. Did you pay the $200 with a credit card or paypal? If so you can dispute the charges with either your credit card provider or paypal to get your money refunded back.
Being a developer I am not agree. What if developer deliver the products and customer dont accept or dont pay? You can see my another reply in the same thread.
Next thing we will see a seller complaining against a buyer who din't pay once delivery received or buyer doesn't accept delivery and doesn't pay. If there are sellers who are scammers, then there are buyers as well. I echo same as "WorkingSmart" otherwise.
