Hi, If its not a trademark name you have a chance to start it up with out any legal problems from others. Is the (name).com have a site up? If it does... The Service / Product should be in high demand. Other wise...I would recommend you have/get the (name).com if you have a choice or look for a new (name).com By having the (name).com you will be a happy business entrepreneur.
Heres a related question. If a company owns the trade mark to say the phrase "Yellow Balloons". They own the site yellowballoons.com and I own yellowballoons.net. If I launch a website titled "yellow balloons" and incorporate it as yellowballoons.net, is this copyright/trademark infringement?

It depends on your example. Yellow Balloons is a very general and common kind of descriptive name and you would probably be able to get away with it if your site was about something different than their site. But it depends on what the website name is, and how big the company is.
