    Well, they don't have a registered trademark, but that is not required. Common law trademarks are also enforceable. My personal guess would be that there is no enforcable trademark because the term is highly descriptive. You can't trademark apple if you sell the fruit. To me, arcadebannerexchange is a descriptive term explaining exactly what the site is about (exchanging banners for game/arcade websites). Whether a judge would agree, who knows?

    Well, considering it looks like he has fake Whois, which means I cant contact him, and I did choose a domain that is suited to what it (will) be doing once its ready.
