Need Help on legal aspect of website cloning issue

    I am working on a script which will look like one of the popular site on net. The code is 100% my own work and not even a image is copied from the popular site. although the working is same for both the websites.

    Is there anything illegal in it. ?
    Am I violating any copywrite act.

    If design is not an issue and we are just talking about the underlying code, then it would most likely be a potential patent issue.

    Patents protect a unique invention, or a new process of doing something useful. I am not as good with the terms as the USPTO, so this link might help: http://www.uspto.gov/web/offices/pac/doc/general/index.html#ptsc

    If you are not copying the process they used to reach a specific result and are only getting similar results with your unique code then you shouldn't be violating any patent... and might want to patent your unique process (if it is valuable and you have some money).

    Make sure to talk with an attorney though!

    If you are not copying code then there would be no copyright infringement associated with the code. If your original code makes a site look like another popular site you could, however, be infringing trademark rights. The look and feel of a website could be protected under trademark law, particularly if it is unique and well known.

    99.9% of the websites, even the major ones, don't patent their processes on the websites, so i wouldn't worry about it.
