I kind of searched for this answer but didn't really find a definitive answer.

I'm looking to put links to MP3 files on my website. I browsed through the adsense policy and TOS and it basically just said no illegal or copyrighted content. Doesn't really address links to illegal content. Also, this kind of goes with the MP3 question, is it ok to embed copyrighted movies on your site?

So would either be against adsense TOS?

    Thanks

If you embed then it is considered content on your site as it is displayed on your site.

If it's my first offense is it likely that my adsense account will get banned, or will it be less severe than that and perhaps have the ads on that specific site disabled/banned?

Your site would be disabled and you would get a mail from google stating a warning and saying that the site should follow google webmasters policy

Ok so movies are clear to me now.

How about MP3's, it's safe to have links to MP3's, but any embedded stuff will get you in trouble?

I would say you're still violating their TOS since you're embedding copyright contents. It doesn't make a difference if it's movie, or music, it's still illegal.

You can contact Google and ask, or ask in the Google adsense forums.

You could try to find some music that is produced under a Creative Commons license.
