I am a 23 year old traveller from New Zealand that has voyaged far and wide. I used to snowboard for a living which got me over to Utah and Colorado for secerals season as well as other place like Canada, Switzerland, Italy and the Czech Republic to name a few. Information about 'Power of Attorney' A Power of Attorney is basically a Document that lets you appoint someone to represent you. The person authorizing the other to act is the principal, grantor, or donor of the power and the one authorized to act is the known as the agent, the attorney-in-fact, or simply the attorney. This person does not have to be a lawyer, in fact that is probably the last person you would want being your agent. Most people choose a relative or good friend, someone who won't abuse the powers they grant, and will look out for their best interests in a genuine and unselfish way. The most typical case in which a power of attorney will be granted is in the case that you become mentally incapacitated. Less weightier issues that one can use a Power of Attorney is when you authorise someone to do a specific task, like if you go away and need someone to sign documents for you. As an example, your agent can sign sale documents or contracts for the purchase of a house, or to sell your car. An agent can also do things like make bank deposits, withdrawals or other transactions, trade stocks and bonds, pay your bills, buy or sell property, hire people to take care of you, file your tax returns and arrange the distribution of retirement benefits. The law requires an attorney-in-fact to be completely honest with and loyal to the principal in their dealings with each other. If the agent, or power-of-attorney is being paid by the principal, the contract for that agreement is in most cases kept separate from the Power of Attorney agreement. A power of attorney may be oral and whether witnessed or not, will hold up in court, same as if it were in writing. However many institutions like hospitals and banks require a power of attorney to be in writing before they will honor it, and they will usually keep an original copy for their records. When the grantor specifies a power of attorney to limited to one special or specified act, this is called a special power of attorney. A general power of attorney is one where an agent may act on the principal behalf until they become mentally incapacitated, in normal circumstances this is when a power of attorney becomes ineffective. If the grantor specifies the agent continue to be effective even if the grantor becomes incapacitated then this type of power of attorney is called durable power of attorney. An agent does not have the right to write or change a principals Will, but they are allowed to establish a trust for the grantor. A power of attorney must be signed by the person granting the authority. The Principal must be mentally competent at the time of the signing in order to make the document legally binding. If there is any question about the Principal's mental competence, a physician may be asked to assertain the persons mental capacity and understanding of the consequences involved in the power of attorney contract they are signing. The signature on a power of attorney should also be notarized. Notarization makes it harder for someone to challenge the validity of the signature. and records the document for use with real estate transactions.
