Name is similar?

    Hi,

    I registered the domains twothirdsmedia.com & twothirdsmedia.co.uk earlier this year saving them for when I have time to make my own web design business.

    Just done a quick search and found that http://twothirds.com/ is a clothing company which has the same sort of logo I had in mind annoyingly. :confused:

    Could this website sue me for having a similar name, and similar logo concept? The only thing I had in my mind for a logo was something that resembled 2/3's of a pie. :mad:

    Any ideas guys? Liked my domain name until I saw its already being used!

    In general, a trademark (registered or not) only applies to the type of goods or services that it is used for. That means that you can't use the name Two Thirds for a clothing brand, but you CAN use it for a media company since there is no likelihood that a customer would think you were affiliated with their company. There is an exception for very well known brands such as Disney and Coca-Cola that prevents those names from being used for any products and services, but that would not apply to the Two Thirds clothing company.
