Has MySpace released any type of statement from their legal department as to what they are doing? Are they really going after sites with "myspace" in the name? Are they going after sites that have the words "my" and "space" in the name (even if not next to each other?) Are they going after sites that have layouts, graphics, etc.. that mention MySpace on there?
Has MySpace released any type of statement from their legal department as to what they are doing? Are they really going after sites with "myspace" in the name? This depends on your site Are they going after sites that have the words "my" and "space" in the name (even if not next to each other?) This probably would not stand up in court. Are they going after sites that have layouts, graphics, etc.. that mention MySpace on there? Not to my knowledge and this probably would not stand up in court also.
Are they really going after sites with "myspace" in the name? Yes, they have sent out C&D notices and have already filed some lawsuits. Are they going after sites that have the words "my" and "space" in the name (even if not next to each other?) Trademark infringement does not need to be exact. It would really depend on the content of your site. If it has nothing to do with "MySpace" the portal, then you would probably be ok. If your content is about "MySpace" you could have problems. Are they going after sites that have layouts, graphics, etc.. that mention MySpace on there? If you are profiting off their goodwill, then you can have infringement problems. "MyFriendBot" has had a lawsuit filed against them for trademark infringement and it doesn't contain "My" and "Space" in the domain name - but the content does. Here is the copy of the letter that was sent to the owner of MyFriendBot before the lawsuit was filed in California. http://dtors.ath.cx/myspace.txt
