    Just curious I run a game site, and I target my site towards Myspace, as the users can add the code to there myspace pages. Is this ok?

    My domain name doesn't have anything to do with myspace, but my page has the words Myspace Profile, and myspace code all over it.

    I think:

    Myspace needs to be in the domain for them to be able to take it away from you... If it is a folder...or even a subdomain...you can keep it...

    So, assuming one foolishly registered a domain with myspace in the actual domain name that offers the normal myspace 'stuff' for users to customize their profiles with, without realizing the legal/trademark ramifications...

    What would be the best thing for said person with the domain to do, assuming they wanted to continue to offer the content? Drop the domain entirely and start all over with a new non-myspace domain name, using the same content? Have the domain name redirect to the new site? Continue using the site until myspace sends a C&D letter? I'm just curious for opinions on this. :)

    Not a legal oppinion but what I would do is register another domain name that didn't contain myspace in it and attempt to transition the traffic to it. I wouldn't redirect away from the "myspace" domain but do whatever you can to promote/link to the new one. Put any new features only on the new one. Set the old one to produce code that links to the new one etc. Then just let the old domain sit there unless/until you get a notice from MySpace.

    I'm obviously late to the party, but was happy to see that someone put a stop to that non-sense. To those with a stake in the topic of this thread, only an attorney can give you the right advice for this situation. Don't listen to wannabe's and posers.

    Almost a year since this thread started. I own 40 myspace in the name domains and no C & D letters for any of them.
    Got one in regards to my site www.myspaceboobs.com before they were bought, I replied and never heard a word since.

    I own a MySpacexxxxxxxx.com domain name and i got a letter from MySpace like 6 months ago that i need to give them the rights to that domain name. My myspace resourse site was one of the first ones out there and it was a huge hit for myspace users. I was banking until 1 million other myspace resource sites opened in 2006. When i got the c&d letter from MySpace i replied to it by saying i was going to shut down the site.

    I redirected my traffic to a new domain name. Now 6 months later everyone knows the site by the new name and the old domain name only gets about 5000 page impressions a day. I still own the domain name, they never replied to my email i send to the legal dept.

    What about if you spell myspace MISPACE...that is ok right?
    i hope so cuz i have one domain like that...lol

    Oh i didnt notice that this thread was started in jan 2006...ohhh yea it was just a scare. Myspace didnt shut anyone down. Myspacesupport.com is still pimpin myspace up and many other sites with the word myspace in the domain name are still up.

    Myspace isnt doing anythign about it right now.

    They sent that crap out in mass quantities. No legal team is going to allot time in court and phone time with attorneys and such to THOUSANDS of sites... its like spam... they just click a button hoping people get scared.

    If they want to shutdown sites that help users keep interest in their own... thats their own fault. What theyre doing is removing capitalism from a capitalistic society...

    Put simply: they're digging themselves a hole, people notice this kind of stuff. I'd tell them to take a hike if I ever recieve anything close to a C+D. They're not going to pay attorneys $200/hr (even if theyre on payroll) to fight some kid about $50/mo in ad revenue. (50/mo is probably being generous for most of those sites im sure)

    I'm going to hold on to my new myspace domain and build upon it regardless of any C&D orders. But I will be careful to add the magic disclaimers of non affiliation.

    I did take a business law class and a constitutional law class in college in learning about cyber laws. Trademarked names such as myspace(whateverhere).com is freedom of speech (am I wrong??) such as paypalsucks.com, I've never heard of any lawsuits or c&d letters written to them. What about adsenserevenuepro.com? isn't adsense a trademarked name? Honestly the "big boys" / newscorp are being stupid with the letters since all the myspace resource sites are HELPING and SUPPORTING myspace. We all know that link backs are what makes the page ranking of another site more popular. Imagine if all the myspace resource sites said screw myspace, give up the domains and then create resources for xanga, hi5, livejournal, facebook, friendster, then Myspace will be complaining even more when they sooner or later become the underdogs and the other community sites will be in favor. I believe Newscorp is screwing themselves over since we all know there are over thousands of community sites on the net. In fact Xanga was first and tom and his partner were huge in spamming when they were let go from xdrive.com, thus how myspace became popular. They spammed thousands of emails to get famous and now acting like the “twinky lawsuits” and bullying everyone (once they got bigger). My website was one of the first “ms(domain).com” created. I believe msbuddy.com was first then msfan.com and I was the third to start msmods.com (ms standing for myspace if you didn’t know). Everyone knows that Myspace is becoming way too superficial meaning all them stupid viagra ads, ringtone offers and fake idiots are starting to send traffic to other sites such as facebook. I also know that the traffic ranking i.e. alexa.com showing myspace in the top 10 is due to all the spam going around. Always remember, spam is traffic in an unethical (mostly illegal) way… The founders of Myspace.com are guilty of this fact. Who do you trust???

    guys, i think you can have myspace in your url and u dont have to give up with it IF you DONT conduct business related to myspace.com... so if you do exactly the same type of website as myspace.com then they can probably send you C&D... buti kind of doubt that they can do it to sites with layouts or so as long as myspace itself doesnt not provide them as i know.. so any activity not related to my space can have myspace in their domainname..

    in another words, i can register NIKE trade mark for producing NIKE ENVELOPES, but i can NOT reg trademark for NIKE making shoes...
