First I apologize for my poor english. english is not my first language I have medical forum(VB) in our native language from 5 years ago. I have 8000 unique visitors perday one site that registered just 3 months ago has copied many of my threads.google mistakes and show my data on his site on SERP by this way he gathers visitors and sell many illegal goods.what can i do ?
email google and ask them to check the creation dates. If they find that yours were made first, then you have something to work with. Also if you plan on going to court, take pictures of your articles with the creation date of your articles and his articles in each photo, then present them slideshow style pointing out the evidence. A video of the same thing wouldn't hurt your case either. Remember to give google at least: 5 article links on your site 5 article links on your thiefs site (preferably try to link to the same articles from each site)
thank you which email address of google I must use? unfourtunately we don`t have good rulles for supporting copywright issues but I try to do by this way how about reporting datacenter of the thiefs site and ask them to investigate? its datacenter is in Denver us
If you can, collect some proof that it is copied. I had a similar situation once, where a website owner copied some of my content, and then claimed it was theirs when I wrote to them about it. So I went to http://web.archive.org (the internet archive), found archived copies of my pages from something like 2002, long before they had even started their website and sent them the link as independent proof. They then apologised, blamed it on some "employee" and removed the content. If you do that and they still refuse, you could try contacting their hosting company about copyright violations. Many hosts have clauses about copyrighted material and may suspend an account if the receive complaints. If that still fails, you could try contacting google. But I suspect they are flooded with these sorts of issues and might not act unless your website carries some weight. But, anyway, try the site owner first with proof. And mention that if they do not remove the offending material then you will be contacting their hosting company and google to have their site removed. Most won't even try calling you on your bluff.
thank you AaronJan Today i found out they completely copied all of my topics(about10000) it seems they did it with a program I serveral times talked with them with email they refuse .it doesn`t needs proof...they say we did it and we don`t remove them...they say it doesn`t matter for them what i do.... now i want to email its datacenter and ask them helping...but I am thinking how they can check our websites that is not in english...I can show them many same content with links of mine and them...
Since the datacenter is in the US, you can serve them with a DMCA takedown notice. At least I think you can, even though you're not a US entity. Google "DMCA takedown process" or similar for more information.
thank you I emailed datacenter.they replied.I don`t underestand what to do? I am investigating what can I do.I don`t understand if I am not american can i send formatted DMCA notification or not ...this is what they sent In order to act upon your request we need to receive a properly formatted DMCA notification or a court order before we will take action. Just go here http://www.chillingeffects.org/search.cgi select copyright in the topic area and submit search. Click through the example claims to google and edit your specifics in place of the example material and fax that to each search engine and host of the alleged infringer. Hi hamids68 you kindly see if there is any security hole in your forum database. They might have downloaded your database and uploaded in their forum.
Here is the link to file a DMCA notice with Google, that explains what to do: http://www.google.com/dmca.html If the person has monitized your content with Adsense, you can file a DMCA notice here: http://www.google.com/adsense_dmca.html You can also file a similar DMCA notice with the theif's web host. It's important that you follow their directions exactly, including mailing or FAXing the DMCA notice, rather than just emailing it.
