My product being STOLEN or Marketed?

... 10 days after the release of OneMonthAffiliate, I find it on Alibaba.com... It's listed as a DVD Box, sold for 67$ and payment method listed is Paypal.

The seller is located in Canada, and I have his address, phone number and name.

... This guy DID purchase it through Clickbank.

What would you advise me to do?

    Alex

First you call him up and tell him to stop.
Second, you send him and alibaba a CEASE AND DESIST ORDER.

After that it gets a little fuzzy.

Hell yeah you wanna call him with some lawer talk man. You are your own business and have every right to sue his ass.

Then as Supper said you need to contact Alibaba as quickly as possible!

I must say congrats for finding it, you never know how long that could be there with the slime ball stealing your profits.

Good luck and keep us updated.

Thanks for advice, Supper. I did call him and left him a message telling him to stop selling it.
... but here is my issue... You cannot purchase it directly. You MUST email the seller for info... So, I am thinking, maybe when there is a request for info, the guy simply sends his affiliate link? So I will scare off an affiliate....

    Hummmm.....

Act as a random customer, ask him for the info and see what he tells you, as simple as that.

Alex.. I also agree that you should buy the product and see what he gives you. Then take further "necessary" action.

Yeah and threaten him if he doesn't stop you'll post all his information on SCAM forums and blogs and you'll also harasse all his future sales on Alibaba. This should scare him enough :D

Just write a letter in legal language sign in name of a fictional lawyer and fedex it to him.
    It always works!

Good idea. I would also suggest this one. So that you may not "scare" your affiliate if he was ;)

Ummm. The buyer pays you (the affiliate), you purchase the product - so you also get your affiliate return - Yipee. You then get given a link to download a product or get given a password or link to enter the website - and then pass that to the purchaser.

Is that the way it works?

Everyones a winner right? Unless they've found a way to crack the vid and be a rat bag.

OR, he arranges a paypal transaction directly with the buyer, and sends the download link to the buyer once the payment is made.

Alibaba IMO is a scammer's haven, and I wouldn't doubt if the seller is doing what I mentioned above (i.e. totally cutting you out of your own sale and product).

If I were you, I wouldn't give a shit about losing an affiliate like that...

You need to take up with Alibaba.com immediately besides contacting this person and asking to stop this unethical practice. Regarding your apprehension about antagonising an affiliate , he has always the option to become a direct affiliate and you need not be apologetic .

Sent a legal notice to him and wait for a few days for his reply.

If you are satisfied (if he is an affiliate of your product ) then you dont have to do any thing. (but i doubt that this is the case)

But if he does not reply or gives any convincing reply send a notice to alibaba also and most likely they are going to remove that listing and may also ban him :D

    Hi Alex,

    This is pretty tricky.

If you don't get a satisfactory email, get in touch with Alibaba - they'll be pretty concerned about it and can maybe help you take it further.

Also, if you search online you can find free cease and desist letter templates which you can then adapt to send him. It will most likely scare the pants off him, as he sounds like he's totally in the wrong.

Also, if he is an affiliate, why wouldn't he just get in touch with you and tell you?

    Good luck
