Demonoid may not be the best choice seeing as its a private tracker, best uploading to public ones like mininova and ThePirateBay and having your torrent listed in torrent search engines etc..
basically, you're screwed, as mininova is hosted in europe, which have far less restrictive copyright laws. furthermore, hiring a lawyer and sending legal notices is expensive...why don't you just enjoy the exposure that the torrent may create for your band and hope it opens up an opportunity for you in the future?
I suggested demonoid in addition to the others because even if your not a member you can still download stuff from the main page. Nigel
Why not use it to your advantage? You're going to get huge popularity in Europe for your music. Let it string out and gain you some popularity. Then one your 2nd album or next album you should have a bigger fan base.
You probably won't have much luck getting them to remove it. You can try, but in the end you may just have to treat it as free publicity. You're doing well on iTunes so at least you're getting something.

Thats all the responses...yea i suppose i have to look at that positive side!! for sure i looked at the piratebay legal page and wow...piratebay people sure are some internet gangstas with those email replys lol... anways we as artists (even major artists) arent even making huge amounts of profit now.. unless you buy your own albums like what interscope does LOL
Nigel posted a LOT of good info and advice. Some of my favorite, big named, bands have uploaded their albums on The Pirate Bay purposefully and even included tracks that you can only get when you download them there. In the mean time consider getting an account on mininova and leaving a comment about the file saying that you are the artist and encouraging downloaders to support you by visiting your site, myspace page, etc.
Newbie01, There are certainly legal channels to take, but since it's not a US company, your likelihood of success is limited. MiniNova is a big problem for US copyright holders. Unfortunately, no one's figured out a way to take them down yet... Sorry I can't be more help. I will say this though, I was looking at mininova's website and they seem to follow the DMCA's takedown provisions. I think mininova follows the DMCA takedown provisions. See mininova (dot)org/faq#copyright. Send them a takedown notice, but if it's on mininova it's also on the pirate bay and probably other torrent tracker sites. Well, as I see it you should be happy that enough people like your music that they are actively seeking it out and downloading it. What you need to do is make sure that your music is available to them for purchase and try to convert some of those downloads into sales. Admittedly a number of them are going to steal it and never pay for it, or are stealing it to listen and see if they like it, then hopefully thet'll buy it. As for getting it removed from Mininova, you may as well give up, it won't happen without the backing of the RIAA and astounding legal fees. Try to capitalize on the new marketing you have out there.
I would take it as a good thing man, sure thats 700+ people who didnt pay you, but guess what? thats probably 700+ people that would have never even listened to your music (because they wouldnt pay for it). If I was making music and had that many people getting my music, id be happy, because thats really good exposure, which in the end will probably increase your chance for success. Think about it, im an avid torrent downloader, and if im looking for music from someone I dont really know, im not wasting my money on their cd (to many people have 1-2 good songs and rest is filler). however, if it is a group that I know I love their music (downloaded in the past) I usually dont mind spending $10-15 on the cd to support them so they keep making more, and I know many who feel the same way. if enough people listen to it, things like radio exposure (if your into that), tours, ect. ect start becoming possible.
Just look at it as good exposure ^_^ Maybe even consider torrenting a few songs yourself with your website on the tags etc to get more publicity ^^
Even if you did manage to get it taken down it would be a short term solution to a long term Problem. There has been some excellent advice in this thread that you could build on to actually use this to your advantage instead.
I am pretty sure it would be easy to get your listing at the top of google and push the torrent site listing away. I have done this for a few people's sites. The reason why I say its easy is that your key words are pretty unique since your name is not madonna or 50cent. Send me a Pm if you want some guidance.
