My iTouch has some problems, are there any known solutions?

Not even two months ago I had purchased a 16Gb iPod Touch, however over
the time it has developed two somewhat serious problems. I need your input
because I get frusturated thinking about my purchase which put me in the hole.

The first problem began around the first week I had owned my iPod. Some
how, some way, dirt or lint found its way through the thin crack and directly
over my display. I didn't think much of it at the time as it was probably no
    bigger then 1mm.

Although the lint or dirt started out small it began to gather, and now there
is one mediumly small speck on the display and probably about another thirty
spawning off of it. The "mother" speck is probably only around 3MM in
diameter but it interferes with reading fine text and is quite annoying.

This has been documented and people claim it is covered by a "default"
warranty, but only in Apple stores. There aren't any apple stores anywhere
with a 60hr driving radious, and that is out of the question.

My second issue has just been elevated today, my volume button is "stuck"
in the upright position. I would like to think this started happening two days
ago when the button seemed "sensitive" (lightly touch it and the volume goes
up) but I can remember this happening off and on ever since I had opened it
up from the box it came in.

It has never become stuck in this position, but while it is the 3x3 inch square
showing that my volume is being changed, I consider the iPod worthless, but
only because you can not quietly listen to music, let alone read, watch
videos or do anything visual with the iPod device.

I have the original everything that it came with and it has absolutely no
scratches or marks (I took perfect care of it) but while reading through the
light gray text on the back of my Wal-Mart receipt it appears as if my
product quality isn't even cared for.

The back has this written on it, "30 days with receipt on televisions, Dvd
players / recorders, home audio systems, telephones, MP3 Players,
GPS Units, post/prepaid phones, etc." which leads me to believe I am
    completely screwed.

Searching my issues on Google just brings me to results with people who
simply walk do to their neighbourhood Apple store, say it isn't working and
get a brand new iDevice with no questions asked.

Do you think I should try and dispute this with Customer Service? Should I go
there and say I had lost my receipt but only purchased it 27 days ago? I
desperately need your input and am not ready to give up on this amazing
    iPod just yet.

    Yours sadly, Kelly2
