My host is ignoring me and refusing to give backups.. is it legal?

were you hosting proxies or normal hosting?
because most hosts do not have servers to be proxy optimized or seperated with other types.
and are very strict then.

 

please tell us what is the name of there hosting company and there URL so that others can know about them..... and its not legal... i think you need to threaten them that you will file a case on them and drag them to the court if they dont provide you the backup or any support.... and i think you need to find a better hosting company that dont sucks....

You a lawyer? great! plz can you post the law that says a hosting company must make backups and if they make, must give to customer?
Sometimes difficult i know bcoz we not even know in which country the first hoster is, but maybe we simple asume that it is us to make it easier for u.

Period end of story.. A childesh behavior would say ,, I WILL SHOW THEM!


In my own experience with hosting. You can not please every one! You can not cater to every one! You can not allow 1 person to break the TOS and say that's ok... and let the others get punished. His host followed a DMCA infraction that can lead to getting the whole sever shut down!

Not the host fault,, Bad judgement on the hosty for thinking he could get away with it...

Yes.. IN THOSE reguards.. The host can not hold them.. I have read hundreds of post, threads, articles on this.
A domain on a web page constitutes COPY RIGHTED MATERIAL. With the host keeping the back ups and not turning them over is theft of copyrighted material.

There is a law that says this: ( Im para phrasing ) A account deamed illegal, a host can hold there files for a set # of days as required by law for investagion! Other than that the HOST has no right to hold any files that are not theres.

First: host would not need to give it out. can simply delete it.
Second: Any post here is copyrighted material too. in most countries this is. if true what you say, DP would have to delete all posts of user who demands, would not?
Third: there is no law that a host must do backups. deleting them can not be ilegal then i think

Esp. that case it would be more secure for host to delete files after some time and NOT to giv them back. simple bcoz it is not BACK. the illegal content is not owned by the customer and giving the files to him might be see as distributing copyrigthed material.

This thread is no directed toward you and only posted stay away from you because you continuously shut off my account while i had 1 proxy site with minimal traffic. But im on vacation and couldnt change my post afterwards. But anyways thanks for making your garbage hosting sound good.

Dont reply no one cares. But yes I have gotten my backups from my old host so my sites are now safely on a mature owners server.
