My host has delated all my info on the server

    My host has delated all my info on their server. Is their any legal action I file against them?


    This is the email i get from them, they have accuse me of spam, but this is not true, I have never spam.

    This was the host I signed up with http://www.aidhost.com
    Worst host ever.

    "We are once again contacted by our datacenter about a problem
    with one of your domains gogettraffic.com This domain has been
    spamming and is removed from the server as it violates our TOS
    and under no circumstances do we tolerate spam"

    I'm so mad right now, the host had my Directory on it, which I worked so hard on it.

    First, I would check your TOS.

    Second, ask for 'proof'. Black list shows clear here, if you haven't changed the whois lately. http://www.whois.sc/gogettraffic.com

    Third, consult a lawyer if you can prove you have damage over and above the time/money consumed by a lawsuit.

    You're saying that you don't have backup of your site on your home computer?

    Oh dear!

    You should always have at least 1 backup copy of any work or any site you have. Never rely on someone else to be holding your only copy of anything important.

    I don't think you can do much if it they followed the TOS.

    I know I was stuped for not saving my data. I wanted to save everything 2days ago, but forgot to do it.

    here is their reply

    "We have written them right after we got your
    message, no reply yet. We are a reseller
    of http://www.icanahost.com
    This issue have also caused us a problem because
    they want us to get all our websites separated
    and they ask for more money now.

    We'll get in touch shortly after we hear from them.

    We cannot continue to provide you services due to this unless
    you upgrade your account and buy your own dedicated server.
    If you would like to continue to use our services you will
    need to buy your own dedicated server starting at $149/month.

    We can't do anything unless you give us more money. ha ha ha. I'm guessing this is either a total scam(assuming you are innocent) or you have to bribe them to restart your service(after being caught as a real spammer).

    In turn with a little creative whois-ing and nslookup-ing it appears that iCanahost might be a reseller of: gnax.net

    God forbid they might even be a reseller of a reseller...

    The IP of the iCanahost server is owned by gnax.net. Further, the iCana website has poor contact information and a generally crappy site. Not that that means anything but... :)

    I supose this is what happens when people cheap out on hosting and why my hosting rates get me laughed at by most DP users.

    Story: When reporting spam, many registrars and hosting providers request full headers. Since people can easily 'spoof' from's, reply-to, domain names, etc.

    I have been receiving 'undelivered email' messages including the original message. The original email message has an email address recipient who doesn't exist on my domain, but the domain is correct. When you look at the IP Address of the 'sender' it is an overseas address, that doesn't resolve to an actual domain. My domains are all hosted in the US.

    So if this happened to me, I might do the following:

    So it is possible you have a cheap hosting provider who didn't research the compliant. As possibility indicated why your admitted domain isn't blacklisted if the spam complaints were even close to being true.

    This assumes you aren't a typical DP liar like many people who complain about being banned, etc...
    Demand proof, and inform them since you think you were wrongly accused, and they failed to properly research the complaint, you strongly feel they have unnecessarily targeted you, and suffered financial damages because of denial of services, and destruction of private property(your sites/information). This should be mild enough, no legal action is mentioned, so you can handle it at their level, and they should be willing to cooperate.

    If not, then you need to see a lawyer. Even if you prove minimal damages(since you need to be proactive in moving your domains over to another hosting provider), you might be able to win a judgement in small claims court. Which you can later advertise on the web as truth, and put a thorn in their sites, and their hosting providers. ;) Be truthful and it's not liable. :D

    When they said they have removed it from the server, does that mean they have delated it completely?

    Many times a host may delete the material. Especially if it is in their TOS.

    The thing is it was their website that made this happen. Their like its good to put this redirect script on your website.

    The data on my website is all gone.

    Get another host now.
    Geesh, it happens when someone hacks into an account and uses it to spam.
    Or they spoof the email of your domain (just happened to me).
    But since all emails to my domain are blacklisted and returned somewhere, it did not affect me.

    I did get anohter host, I'm waiting for them to set it up, but all my members accounts have been delated. So I have to start from 0.
