Step 1. Check to see if your site is listed in the way back machine. See how far back they show it. Also check if copy cat site is listed in way back machine. If way back machine shows yours older than his would think you had a basis for DMCA complaint. If he is still running your adsense code contact Adsense immediatly and report it.
