    The OP is looking to circumvent prosecution for doing something they know is illegal.
    That is doing harm in the books of anyone with a grain of moral and ethical standards.

    Those that advise how to do it are also acting illegazlly and are guilty of contributing /assisting in carrying out an illegal act.

    As for the mods not taking action against posters of illegal activities I am very much against this policy.
    They may not realize it but it calls into question their ethics as well.

    This is kind of risky. If someone who wants the name gets to know this (which can be done through whois) then they might report it and then have the domain for themselves

    They don't just get handed the domain after complaining. I'd find it remote at best that something serious will be done unless serious complaints are lodged.
