Hi friends, I created a word in my mind to create my site (for my domain name). This word is so so so rare (almost never used). When i searched on google, a person already used (he believe , he created this term first time with 2 words / mine is just 1 word) this term. But .com is available. Do you think, i should take copyright or if i take .com, it is enough? Is it possible special trademarks for domain names? Or if someone takes .com first time, he is owner of copyright? A copyright covers expression of idea's, content,ect. Whereas a Trademark covers a word, symbol or logo. In your instance, the individual would have to have trademarked the name. As long as your website doesn't look materially identical to his and it's clear you copied his content or design, copyright would not apply.
i think domain name is global entity where as trademark are local entity ...so what happen in that case for eg, user a has trademark of it in country X,and domain is registered by person of country Z or User x has trademark for the same logo in Country A and user Y has same trademark(in some way) in country B
it depends how his domain is doing if he is using any TM on hjkge then still he can claim. but it appears that guy may be thinking newhjkge is itself as a new single word then its fine is the hishjkge.com is developed or parked ? if it is parked then probably u r safe to reg and use
he doesn't have any domain name. All domain names are available. But i saw his writing on a site,he says that he created this word. I created this same word in my mind too. But he doesn't have any website. So i think, i'm in safe, i can take this domain name. eg: i created a new word : taker, and taker .com is available his term which created: new taker So i can use taker.com safely? thanks.
