If your site was indexed by google before he did this they will see his site and duplicate content. Your site is the original content in thier eyes and will not be hurt.

Google wont blacklist him for copying your content, They just wont rank him highly on searches where it appears. So you will still rank above him.

it's unlikely, Unless his competitor has a much better site that is indexed much more frequently, And if that is the case i doubt he would be stealing content

Yep. If he's planning on putting in the work, he's probably not the type of guy who would steal content. His copycat site will most likely go nowhere.

    Hello,
If you have a copryright of the text, you could send an email tell them about it, and maybe you could talk with a laywer...

You don't need a copyright. it's protected by intellectual property. Not that it will make any difference. It's unlikely someone is going to contact a lawyer over a few copied web pages.

If his site is ranked higher than yours, his content may replace yours in the serps.

This happened to me with a site that copied content from loads of our pages and took our place for loads of searches. When we rung the copycat site though, they took it off immediately. so it may be worth worth simply phoning to ask.

I'm afraid your competitor might go away with it if their popularity is higher than yours. It happened to us in the past. We had to deal with it through the lawyers. Best think to do is writing a letter warning them that if they don't remove the plagiarism you'll take them to court

but isnt the spam reporting tool supposed to merely help google with improving their spam catching algorithms? I seem to remember reading a quote from some googler saying we dont act on individual cases.

Ild report some people if it was different

Try to report it to google. Previously i've reported a site which cloaks their keywords! After a few days, google banned the site. :)

First thing to try is sending the email to competitor asking to remove your content from his site. This might help.
