Well, I have a forum now, and a lot of the members from my forum love the music feature from my site. I know that it is illegal to have Illegal Music Files from your site, however, I only use LINKS (URL) from other sites. In the other word, I run my music files from other servers. So is it still Illegal to do that? Will I get any trouble or problem doing that?
Best that you get a lawyer for this type of legal advice. First thing I've learned about large company's, even-thought you might be in total line with the law (maybe 'fair-use' here), they can force you to prove it in court. Which could result in substantial legal fees. So, you have to decide, which fights are worth fighting. good luck, tom
Thanks Tom, I'm not really sure about this problem since a lot of websites I know have the same Music Script as mine, and they also use the same way to play music on their sites, without having any trouble. I don't really want to get to any laws issue either, so it's really hard to decide what to do at this time (either remove that, or keep it), since I got a lot of traffic from it.
Like I said, you need to see a Lawyer, and I am not one. But I can comment on what I've heard, the RIAA has been successful in shutting down bittorrent sites. These are sites that didn't have the files, just links(or program directions) to where the files resided. hth, tom
First off, make sure you have permission to use the music from the other site. Even if that site is legal, its always possible to be illegaling using legal materials But a lawyer is deffinatly your best bet. Josh
as what you said, that is illegal. better ask legal assistance from a specialist to clear things out. anyway, more power to your site!
I agree with the rest of the guys here for you to consult a lawyer on the legalities involved in using Music Files especially illegal Music files in your site for your peace of mind.
I'd be careful if I were you. Music companies are going after anyone who assists in illegal music downloading, such as this mother of a 14 year-old who was downloading and sharing music. Even if you ran the site until you got a 'cease and desist' it could still prove very costly as you could be hit for every track, or a reasonable estimate of tracks, that were downloaded via your site. It's still very murky as far as what is, and what isn't legal but I'm sure the companies involved are only too happy to go after test cases.
the recent Supreme Court Grokster decision found grokster to be liable even though they did not have the music or media on there servers. Check out the caselaw... its very recent. However if I were you I would not worry it.
