I figured I'd try my luck here, before I have to pay a lawyer. I first got a settlement offer, but didn't have the money for that. I can get the money now(a loan), but will they still settle? I'm afraid if I don't get this over with, there going to put a lien on my stuff and garnish my wages. Its also a civil case. Do I file Bankruptcy? Do I try to settle AGAIN? Do I just ignore them?
If you're within their reach and in a lawsuit, ignoring them can be a bad idea. But you can ignore anyone else here telling you to ignore them since it's your behind on the line, after all. Just talk to an attorney. Fast.
I've never dealt with the MPAA but I bet they'd be pretty serious about following through. I'd go ahead and get an attorney...
if the suit is against you, vs. your company, look for a civil litigator (corporate if it's you corp.) and see if you can get one to agree to a flat fee for contacting them seeking to accept their offer. If you have a credit counselor/bankruptcy advisor they might be able to inquire on a possible settlement, without making you look like you have no professional advice. Get him to write down what he/she will or won't do the price. You could try contacting them directly, but that pretty much let's them mess with you since you have no representation.
We ask you what you did, and you say you don't want to talk about it because it makes you mad? This makes you sound like you did something blatantly illegal. Were you counterfitting DVD's? Displaying pirated content on websites? Or just downloading movies from torrents? If you don't want to sound like a badguy, which you do right now, you should say something. follow up PS - I'm not trying to be mean or anything, because we'd like to help, I'm just stating what it sounds like to an average thread reader.
Have a lawyer tell them to blow it out their ass!!!!!! and no I am not kidding. They make me so mad it's not even funny. Never, ever, settle that sort of thing as it is an admission of guilt. http://torrentfreak.com/mpaa-caught-uploading-fake-torrents/ these folks may be able to steer you in the right direction. You need an attorney who understands this sort of landscape. http://www.eff.org/ The mpaa's logic about tracking people via IP is patently absurd. hope that helps, Nigel
So this company is really itching in the ass right now, this is like the fifth small man case (compared to that company’s largeness) case I have read about against that company. Get a professional lawyer because it would be hard to get constructive advice here about the situation, honestly.
First thing to do is find out what you are doing wrong and why they are suing you for. If it is because of placing pirated contents or using copyright materials on your website without permission then offer to take them down and issue an apology and vow never to do it again. If you get hard with them and insist that you are in the right, they will come hard on you. So unless you have tens or hundreds of millions of dollars to launch a countersuite, it is best not to even get to court. Most companies would most likely not need the lawsuit money, they just want their rights to be protected so a simple apology may work wonders.
The MPAA and RIAA is known for suing random and innocent people. They have sued people with no internet, 80 year old people with no computers, and even one person who was actually dead. I suggest not to settle, but get a good lawyer and fight them. But this is depending on what you actually did of course, and if you're willing to go through the trouble and hassle. eddy2099: The MPAA is the exact opposite of what you say in that last line of your post - they sue for the money, not for rights.
.torrent site? They can't do anything to you.Just remove your domain to better hosting in better country if you don't wanna bother.
Never EVER settle with them. There are so many laws out there that protect you it is not even funny. 90 percent of the time they are not even serious. Do some research you will see what I am talking about. In fact I know of a place where you can transfer your domain and your hosting and they will never fidn you.
Folks, as much as I understand your sentiments about MPAA, no one is really doing the OP any honest favors here telling him to "fight" them. The OP has not stated what exactly he has done, and revealing more details in an online forum can possibly do more harm than good. Bare minimum, he does need to see a lawyer to review any and all facts of his situation. This is especially crucial if he's already been served notice of suit. To the OP: I suggest doing what eddy suggested. Of course, it's still your call if you want to fight them out of pure passion or use your head and try to find out how to resolve the issue. If you decide to follow these other people here, just remember that they are not the ones taking the fall for you should it turn out you violated a law.
All I can say is if you really did anything illegal that would justify them, quit asking for help and pay the fine, it is only ethical or if you believe you reserve some right you can attempt to take on a battle but it’s not worth it if you did something wrong.
When someone is suing you, the best thing you can do is either defend yourself if you are paralegal or well versed in legal matters or get a lawyer. Do I file Bankruptcy? It is not easy to file for bankruptcy for your information. Do I try to settle AGAIN? That depends, since they already sued, you need to consult a lawyer to draft out a letter for settlement. Do I just ignore them? Never, once sued ignoring it means that the judge will take this to your disadvantage, you need to reply.
There were some legal agencies or organizations that aid people with legal support to fight against the mpaa. I forgot who exactly they were. Maybe search a bit. The mpaa sues both rightly and wrongly. Actually they sue everyone who they can get their hands on.
