MP3 RINGTONES, cutting portion of MP3 file. Is it LEGAL?

    I was wondering if I take portion of a song and turns it into MP3 Ringtones format, or iPhone ringtones format etc. and then sell it; is that LEGAL?

    Nope, copyrighting, and editing material. Copyright Designs & Patients Act covers that under UK law, if your American, there will be something similar.

    It has already been said that it will be illegal. You are still taking a portion even if it is the first 5 notes of the song, it is still part of the original song, therefore still copyrighted.

    You can't do anything beyond having the song for personal use as a ringtone.

    But that's what mobile community sites do.. So are they illegal? They're sharing a lot of ringtones there.

    Yah.. thats what i've been wondering. If it is illegal, but nobody is doing anything about it. Then shouldn't that be considered legal?

    Yup you would be promoting the song sure. And doing it illegally. The music industry is doing as much as they can to prevent such activities but cant get every Tom, Dick and Harry atm. But they eventually will get slapped around a bit. Just because you see a few doing it and you know it is illegal, would it make it legal if you jumped on board and started doing it yourself? The answer still makes it no and what you are doing is illegal.

    Besides it sounds like you will and are doing it no matter what you ask here. So stop asking for validation.

    I do not think they're promoting songs by doing that.

    I believe the Music Industry are making a lot of money with ringtones. Because of these mobile community sites, ringtone sales are dropping.

    Unless you control the copyright or have express written consent from the copyright holder or its assignee (normally the Label, writer or Publisher) you can't do it.

    My suggestion would be to write your own music and sell it.

    My guess is you can't do it. NOT MANY PEOPLE CAN.
