Well, this doesn't surprise me. I'm not a psychic, but a few months before 360 came out I was telling everyone how it was being made in China and that it was going to be a rip off. Now it has come out that the system has serious problems. Problems so serious that one guy in Chicago has decided to go after MS in a class action lawsuit. I pity the fools that ran out like good little slaves and paid for it. Well I'm not surprised that the new system has problems. Car manufacturers have to do recalls all the time over things. However, I think a class action lawsuit is a bit much. What compensatory damages will be awardable? Million$ for not getting to kill cops and judges in the latest games? The system locking up may cause aggravation, but so long as it's not causing real damage, at most, MSFT will be forced to refund or replace. I'm neither an MSFT fan nor supporter, but I don't see this being their demise.
A lot of people point to Dreamcasts demise and Nintendos near demise by Sony as proof that Microsoft is next. The difference is money...Microsoft is willing to lose billions (and did last year), something Sega and Nintendo couldn't do. Everything I have read showed that the locking up was a tiny percentage and I just don't see the class action suit. I'm no Xbox fan but I can tell you they will lose less money this year and there will definately be an XBox 3 (or 480 or whatever) I do find the fact that even some of them crash pretty funny.
I'm not a big fan of microsoft nor am I a microsoft hater. I don't think the XBOX 360 is that great from what I've seen. I do, however, like the Xbox a lot better then the PS2. As far as the guy bringing a class action lawsuit for the machines locking up, that's just stupid. Big deal. What damages did he suffer. I hope he accidently burns his balls off with some hot coffee that has a warning on the top of the lid.

I think the estimate for defective xbox's is around 5% or less. Not good but not particularly bad either considering they rushed the project to get it in on time for Christmas. Microsoft will probably just replace any defective ones without any fuss in order to get maximum good exposure in the press for their gaming machine before Sony launch the PS3 in the new year.
In all honesty, doesnt this person have better things to do then waste time. Because thats all he is going to get out of this pointless, time wasted + 3 minutes of fame. I can't believe he is refered to as 'man' in this article. What kind of 'man' sues over a xbox flaw. Did this flaw cause him to not sleep well at night or some kind of erectile problems? I hope they show a picture of his face so I can express my hate towards him with photoshop. What a loser!!!
