    Its pretty brutal on behalf of Microsoft, but people who choose to mod their consoles take that risk knowingly. Not going to stand up for either party, but I do know that Microsoft do have a large law suit on the way, as alot of disgruntled xbox users are upset that they cant even browse the web using their Xbox anymore, which is a service completely unrelated to games.

    Its going to get messy, I can see it

    then microsoft throws their terms of agreement for use of their service in the lawyers face and you have a case closed. With paying the amount of $50 it only says they provide you with a working online service accessed through an "unbanned" system. But the violation of the terms/agreement is where the laywers wont have a case against microsoft. They covered all angles on this one it looks like.

    It's simple.. you cheat the system you pay for it. Stop modding your 360.. or have two.. 1 for modding and one for general...

    As for moving to a ps3.. what's the point? you can't mod a ps3 right now. And, I'm sure when finally someone does mod a ps3.. the same will happen. Microsoft and Sony can't afford to lose $ from modded machines... they are trying to protect gaming companies from losing out.

    It's exactly like pirating software... buy the game and stop burning them.
    Anyone with a modded system DESERVED to be banned.

    it doesn't matter.. you cant mod a ps3. and MS won't ban you off live if you don't mod your xbox.. so your fine.

    Well don't mod your Xbx if it's against their terms. Also if you're a modder but don't play copied games then simply don't take your xbx online.

    nawww I hope not.. they should make all the modders goout and buy a new 360.

    I know my friend in the UK had a modded xbox. I found out he was 1 of those million banned users, and now he bought a new 360. Serves him right, but im happy he decided to go the right way.

    I would say 360.. unless you want a bluray player too.

    Because, most of the games out are made for both consoles these days. However, I find programmers for games find 360 or prefer it more, because it's a lot easier to use and create games with compared to ps3. So, some games are given more preference on 360.

    also ps3 right now is free online play 360 isn't.. and ps3 has wireless card built in and 360 doesnt.. both systems have pros and cons.. it depends on what you want.

    I wanted a ps3.. it costed to much and went with a 360. Then 2-3 weeks later ps3 slim came out... wish I had waited or known... but it depends on the price as well.

    I would get a 360 if I was you. They have more variety of games then the Ps3 also a larger online audience.

    Exactly.. it's like you use a ILLEGAL copy of IPB and get busted.... You were doing something ILLEGAL. You can't complain about the host not returning your money after they close your account.

    You broke the TOS.. and Microsoft has a TOS on xbox live as well. Don't break it....
