    Person is no more alive any idea who owns the trade mark now??
    Dozens of them are sold daily with his name in them. I don't think anybody's gonna stop us.

    Not sure, it could be a family member or whoever was set as the successor in the TM. You could take a look at the USPTO TESS database and look it up, it will probably tell you on there.

    Keep in mind that yes you can sell it, but the TM owner and their legal team are probably watching these transactions and have the full ability of going after you if caught..
