No, I looked into it beforehand. If I was launching a newspaper then there would be a 'passing off' issue, but since it's unrelated there's not a problem.

I can't see any trademark issues with The Metro newspaper. Metro is a dictionary term for a city area ... London is a city ... as Matt said, there is no confusion at all derived from this domain and I'd be very shocked if there were any legal issues (of course I am no lawyer).

I had a chat with our company lawyer regarding this. He said its a none issue. Metro is an english dictionary term and not a derived one eg ebay, google, yahoo etc. and so it can be used with any business provided it wasnt being used by an existing functioning business that had trademarked it for that use. Eg i could create a busines called Amazon Floor Coverings. Eventhough Amazon is a world famous trademarked name.. its only trademarked in association with selling books.

Matt would only be infringing IF he 'passed off' his website to be the Metro newspaper which he certainly isnt doing (in other words he deliberately wanted to give the impression that his website was in anyway part of the Metro Newspaper). Its obvious that the metro london website isnt anything to do with the metro newspaper, its distinctly different.

So Matt is 100% in the clear, so would anyone who bought the website.

Thanks for your comments guys. I have a friend who is a lawyer, part of his job it copyright and trademark law in the UK, so before I buy any suspect domains I always check with him first anyway. Good to hear some confirmation though also :)

MattUK - I was not questioning your "legal status" or mess your post - just wanted to be clear about things as I am interested too.

The other posters have clarified a little bit on that front. I will sit by and watch how the auction progresses ;)

    Good luck
