I know that many Master Resale Rights are prohibited from being sold on E-Bay, although this does not stop many from doing it. Does anyone know of legal issues / cases that have arisen from e-bay sellers selling prohibited items? thanks
I don't know of any cases. Ebay usually stops the auction and penalizes the creator by suspending their account or possibly terminating the account. I think they give a warning or two first. They may keep the listing fee too. To warrant a court case, you would have to be doing it over and over. It's easier and cheaper for them to just cancel your account.
Haha good old ebay.. Before comming to DP I must have bought a couple hundred dollars worth of 'resell' products on there, YOU CANNOT resell them unless you have permission from the original creator. Do your research on each script (google is a good place to start) you'll find that most of the products you mostly bought or were going to, you can't legally resell. IF you purchased a product that has resell rights, and you do end up reselling it, and getting found out... doesn't matter if you were lied to, you will still get fined.
It's illegal, but I don't think eBay wanna touch the dirty water. It's their life line; it's what has fed them to be such size of a company. The outcome will depend on the original creators. Nobody has started to take any legal action against it, yet. That's because either they are still analyzing if such sales would benefit them (which I don't think they would take so long), or they have already determined that they do bring great benefit to them. It's also possible that they are waiting for someone to get it started.
Yeah, I think there are many copyright laws being crossed. I make sure I buy from only good sellers. Then I make sure when I sell I sell only master resale rights products and keep the resale license intact.
