Depends on where you're sending them from and how you obtained them...

Here is the Government Law on Spam Email. And here is a state by state on spam email info. Both give info on how to do it properly and legally.

I would say YES. Mass marketing spammers have successfully been prosecuted in criminal court.

Watch out!! Spamming is becoming illegal in more and more countries everyday (thanks GOD!). But if it was the account owners who gave you their details, they knew you might pass them on to third parties and you can prove that, you can sell the database.

The cold hard fact is this...

The moment you harvest e-mail addresses electronically, it's illegal to send them mass e-mails even if you comply with the rest of the Can-SPAM act.

I'll tell you right now, no one hand collected 8 million email addresses.

It's not illegal to send them an email. But here's the thing: those emails must contain your REAL street address, include clearly visible unsubscribe link, and the receivers must have opted in to your mailing list. By putting your real home address, I don't think you dare to send uninvited emails marketing illegal products.

Laws enforcement officers has been arresting spammers. Million dollars fine plus jail time.

It is illegal to mass email, unless they request for the receiving of such mails. It is not advisable to mass email because:
-They received mail that they do not expect.
    -It is associated with spam.
    -Some people do report spam.
-Your site get's blacklisted for appearing as "spam"
-It is illegal, under US law.

In the UK you must have received the persons express and active consent to have emailed them (for individuals) and cannot get their implied by their failure to tick a box etc. For businesses there is no consent required however you must know for certain that was gathered as a business email address and not their personal email address that happens to also be their work email.

It is the duty of the sender of the email to ensure that all permissions have been correctly sort - the sender is not the person company who actually presses the send button on the email but the ones that instigate the sending.

its illegal but of course there are ways around it. You can buy a server in a different country and have it that it sends out the mail from there, They can't do anything because the server isn't in the same country.

IS it illegal if you use some sort of "Unsubscribe me" or "Don't email me again" button on the footer of the post?

I agree it is illegal in most countries around the world. You might just get your ISP to act against you.
