Man sued for libel after leaving 'negative feedback' on eBay

    A mechanic who bought a phone on eBay is being sued for libel after leaving negative feedback on the auction website.

    "The item was scratched, chipped and not the model advertised on the seller's eBay account."

    And now the poor mechanic has received an email threatening him with libel action.

    Do you think this case will go to court, knowing that receiving feedbacks (positive or not) is part of the service?

    No I doubt it will get to court, what lawyer would be stupid enough to take such a case on?

    Isn't there terms and conditions you have to when signing up for an ebay account? Surely there's something about the feedback system in there which means the seller will get laughed out of court.

    if that gets to the court , i am sure Mr. Read might get some money to buy more than 1 phone he wished for...

    If it was truly damaged and not as per the spec, then the guy have nothing to worry about. Leaving negative feedback is the buyers' right. I would go along the way to fight the case.
    Maybe he should have backup his case by taking the photo before returning to the seller or else there will be dispute.

    The main thing to consider here is the guy received a full refund for the phone he purchased. Therefore, the case purely rests on the libel action not whether the good were as described.

    If it goes to court and the guy who got the negative feedback wins. Beware of what you say anywhere then it will bite you in the a$$. But I am sure it will not even make it up the steps of the courthouse.

    You can't really take feedback back can you? Either way, if what the guy said was reality, then he has nothing to worry about.

    I think this seller is out of his mind. He shipped the wrong product at first place. He should sue Ebay for allowing buyers to ruin his reputation.

    Hope the right guy wins if it goes to court, but as history has shown me at least, tis not the case most of the time.... :-(

    NEGATIVE feedback is ALLOWED as long as if its is valid and the item recived or service is worthy of negative feedback its part of the service and its a dumb case for the seller...

    Ebay disallows negative feedback so I dont know why the guy still disobeyed and did that. phew!
