Lost my domain name but it is trademarked.

    In 2005, I started an LLC and trademarked the name of the business. I also purchased a domain name which was trademarked.

    I forgot about the domain and it expired... someone bought it up right away. Can I get the domain back? Do I have a leg to stand on? They have a spam/parking page there right now.

    but to your question..i think the only way is to buy it from the person who has that domain...

    They are related in that they're both intellectual property issues. But this is the "copywriting" forum... not "copyright" forum... big difference. ;)

    You may be able to get the domain, and you may not. A trademark isn't absolute... if they're not using the name for something confusingly similar, you may not have a choice but to buy it from them. But ask in the legal forum, and you'll probably get more help.
