Hi Folks! That is one year old registered domain. I never developed any website for it. Its Keywords domain. Estibot giving $510 for it. I want to know your appraisal for the domain mentioned in subject. Thank you.
It a domain with a registered trademark - one that is owned by a company that likes to sue. I would get rid of the domain by dropping it.
Thanks for your view. How is that ICAAN allowed to register such trade marks in case if its not legal? Part of the amount would be given to ICAAN while registering. Not just with this name, I am curious to know in general.
All domain registrars have fine print that says it is your responsibility to check for possible trademark infringement BEFORE you register a domain. A comprehensive TM search can cost hundreds of dollars and they aren't going to do it for a $10 registration fee. Trademarks in many jurisdictions (like the US) don't even need to be formally registered anywhere to be valid (common law mark).
Thanks for bringing that point. MS is not their rtmark (rg tmarks MS-DOS, MSDN, MSN. ms.com directing to morganstanley.com. So MSN is nothing to do with ms I believe) When it comes to excel word there are atleast hundreads of fully reputed domails like excel.com excelindia.com excelsoft.com like many more are there with excel word included. I inquired about this with few webmasters the main thing is as long as site promotes its products and give affiliate links to it and mention their tmark is owned by respective then there should not be any problem. In fact it encourage people selling their products more and more by providing advantage, help tutorials. Anyways thanks for your inputs after that things got clarified.
Whomever gave you your information is wrong. You can have a domain called excel.com as long as it has nothing to do with Microsoft products. The part about promoting their products making it ok is complete bs and perpetuated by ignorance of the law. I have about 20 years experience in intellectual property rights disputes and your domain is worthless as it clearly infringes upon Microsofts trademark. They can take the domain with a WIPO action and/or sue the owner. Since they have a federally registered mark, they can seek not only damages, but treble their legal costs - potentially hundreds of thousands of dollars. Microsoft has taken action against thousands of domains. Drop the domain.
Finally i could manage to get rid off it and make some 40 bucks with this forum help. Thanks for your advise.
