Considering you'll have to pay for a PSD design and then coding on top, it'll probably work out cheaper to just pay the $49 in the first place, it's not alot in relation to most premium themes, and mega cheap compared to getting a proper custom theme designed in the first place And remember an exact clone of the theme is just as illegal as getting the theme off a pirate site anyway since it still infringes on the design copyright.
