hi guys, how can I force the guy to remove my logo from his site? it is obviously a copy cat....a very unprofessional one... my site: http://webhostinggeeks.com copy: http://webhostingpreview.com thanks in advance
im not sure if you can make him, shoot him an email tell him hes using your logo without permission and you want him to remove it, see what he says then take it from there.
This is as far as i would take it...send him a strongly worded email and see if he bites...otherwise you time and energy is better spent elsewhere. If he is determined, it will not be worth the effort to try and win this one...in my opinion anyway...
Logos are copyrighted material, so if you really want to pursue it, there are many steps you can take. First, send him an email and notify his host as well. See where it goes from there.
Looks like that idiot did not even change the name of your logo when he copied it: webhostinggeeks-logo.gif http://webhostingpreview.com/images/webhostinggeeks-logo.gif
Lmfao tell him your going to be nice in asking him the first time and tell him to take your logo down if he doesn't within 3 days threaten him with a lawyer... usually is convincing enough and if he still doesn't copy (what an idiot) then follow through with the threat
if you got prove its yours then certainly go after him, it is clear that they just added a white box on the logo to put their text on top off - very unprofessional
i would love to hear your story after the idiot was taken down. ^^ I,in any way, sure that lawyer is the best solution in this case after all advice here has been followed.
The best way to sort out these is to send these a strongly worded message, usually they cower down. You can threaten and not actually take action
Its going on the third day since you asked us, whats the status of this? I can see he still has it up....
RSOUG: Wow! that's pretty blatant, huh? The first thing I would tell you is that you have common law trademark rights in the logo. Even if you don't have a registration for that logo, you are still protected under trademark law. This means that the infringer is violating a variety of federal and state laws by including your logo on their site. Here are some articles which you might find helpful: What Are Common Law Trademark Rights? You Don't Need Have a Trademark Registered with the USPTO in Order to Protect Your Common Law Trademark Rights in Commerce Top 5 Benefits of Trademark Registration Using Threat Letters to Enforce Your Trademark Rights I would recommend that you consider registering your logo as a trademark with the trademark office. This will give you enhanced rights including a presumption of trademark validity as well as the ability to threaten statutory damages up $100,000.00 per incident of infringement, plus attorney's fees. If you have any amount of time or money invested in a logo or brand name, registration is probably the easiest and least expensive investment you can make in that brand. If the infringer does not voluntarily agree to take the logo down or does anything else to suggest an affiliation with your site, you should consider hiring a trademark attorney to help you increase the threats and leverage. Haha... I can see he did some minor edits, and now his version looks like crap! Wow. Did you e-mail his host yet? If you have any sketches or the PSD file of the logo, I'd think that would be proof enough to ask his host to take down his site.
