Local Insurence want to take down my site about them

    So here is the story:

    After terrible experience with company in insurance business here in my local area ( Europe ) I bought and make site about how they do their business, I ask some question and did some research on local forums and information I find, I posted on that site in form of blog.

    Now, the problem is I bought the same name domain .org and they have .com interesting thing is they don't have local extension I don't know why,but just .com.

    Translated from my language to English language it would be something like this. Company Name is one Word but I'm not going to write it in public.
    companynameinsurence.com
    companynameinsurence.org (mine)

    So this morning I got e-mail from enom with redirected e-mail from Lawyer of that company claiming this is malicious information and malicious web site with false information and they want it to put it down.

    Whats should I to, do any suggestion.

    I'm not violating trademark or at any kind profiting out of this, I'm simply posting stores I find on forums people complaining on their business, my goal is just to let everyone know who they are and how they treat customers. Also I have second place on Google local search when type their company name "companyname insurance" just below them.

    In the US you have a right to use the name as commentary and there have been quite a few cases where it is allowed. Make sure your facts are accurate and you do not profit off their name or brand. I would say ignore the threat and do not reply until they take legal action or file a UDRP.

    Hi,

    My suggestion is to take the site down. We all have bad experiences with companies from time to time, but you cannot expect a company to let you use their name to rubbish their brand or service. You'll end up in court.

    You have a right to express an opinion and write facts about your experience, but use another method. Find blogs and forums, or start a site with a different domain name.

    You will have to eventually take the site down.. as after all you are using their company name. If you wanted to expose them, you could have twisted their name and registered a domain name sounding similar... but not the SAME!

    The truth is you can leave that site up until they get a court order
    to make you take it down, I would post the letter that they sent
    requesting the site to come down and prove the truth of my posts.
    then delete my email account off the site and pay for private reg.
    on the domain, then they will need a court order to find out your
    new email, so they can tell you to take it down, by then you smile
    and take it down and say - got ya !!! "Don't Tread on Me."

    I think that they have right to take the domain from you since it is a trademark.
    Additionally, they can ask you to prove the accuracy of the information on your site.
    If you can't, they can ask you to compensate their loss caused by the false information on your site.
