Links being penalised

I've recently received an email from a link audit company saying that they have contacted the Google Webspam team. They are saying that their website is being penalised due to the link on my website and they are requesting it removed.
I have checked Google Webmaster tools there are no manual webspam actions taken. I would think if I'm being penalised then it should show there.
My question is, should I worry about this email, is the owner of the other site just paying for a service that they really don't need.
Or should I worry about this situation because to be honest I've looked and looked - how would I know whether I'm being penalised?
For the repliers don't respond offering website audit services IT'S NOT GOING TO HAPPEN!

Just remove the link for the guy. It won't take you more than a few minutes and it could help you be sure that your website isn't penalized later if/when this guy files a reconsideration request or disavow file.
Remember that if Google starts seeing a pattern that your site is linking to people without their will they will can take action on your domain.
