Linking to Movies...

    Im confused about the issue of linking to movies online. I know tv-links got shut down and the owner got in trouble even though the files were not loaded onto his server. I heard he got cought because theres a difference between youtube (and other sites) hosting it and not knowing about it and you knowing about it and linking to it.

    But then again, I see many "tv" and "movie" sites linking to new movies etc.

    Can somebody please explain?

    to be on a safer side , you add a disclaimer on your sites footer saying that , "we don't intent any copyright violations and if the material on our website is objectionable to you we will remove it ",or any other crap like this
    i am in India and i also do the same on my website of online videos

    A disclaimer does no good legally speaking. There are several factors that lead to these sites being up.

    -The sheer number of the sites that are up means that some make it through the cracks.
    -The country where the owner and host of the site is does not respect copyright law.
    -Nobody cares about the particular material that site is linking to.

    etc....

    People speed without getting caught every day. That doesn't make it legal.

    tv-links had several things going wrong for it. One, they uploaded some of the links themsleves (YouTube does not post anything). The format of the site made it clear the intent was to upload links of tv shows (which are copyrighted). The url also made it pretty clear. It has been said the site operators did not respond to takedown requests.
