Hello I have a relatively new mountain biking website. I was thinking a great way to launch the site would be to put on a video contest. The last thing I want to happen though is to get sued by someone claiming that they got injured while filming to try and win the contest. My buddy works for red bull doing video stuff and he explained the liability issue to me as this: The liability is between the people filming and the athletes. If people are not paying to enter the contest then I am not responsible for what happens. The videos just happen to be entered in the contest. Now I do not know if that is correct. I was thinking that I would post a common sense style disclaimer anyway at the bottom of the thing. I could not really find a precedent contest that I could look at the disclaimer for. I found this one for a shimano video contest. Would something like this cover me? http://quickrelease.tv/?p=6 Thanks a Ton
I think you need to talk to an attorney. The law will be different depending on what state (or country) you are in and where your business is located. The precise wording of any disclaimer will be different depending on your exact circumstances. And, of course, disclaimers can't prevent you from being sued, although they can be used in your defense in court. You probably also need to consider age for your contestants.
By speaking to someone who knows the law for the country will have a better idea. More than likely a disclaimer will be used to state you won't be held responsible for any damages etc. But see someone so it can be done properly!!!!!!
Just get a disclaimer from a attorney for your contest. Just make is visible in your contest main page That should be enough
