Hi , I design websites for different clients ( surprise , eh ? ) . Now currently there are often several clients , who have a predetermined idea about designing clones of other websites they have visited earlier . As a designer - developer , how does this affect me ? Should I be worried in anyway ? Is it necessary to get it in writing from the client that he is liable for any arguments or notices from the original website , if any ? Furthermore, if the client even provides written or emailed confirmation for the same, is it prudent to display my website link in the footer of such a website ?
there is nothing stopping you from taking a layout. using the exact same (custom) theme is considered misuse without the creators premit. another thing you should not use is copyrighted images, or trademarks. Duplicate content is another big no, due to copyright laws and international agreements. You can reuse content, but credit is due where credit is earned. Web Designers can be submitted/named in a civil suit if they take part in duplicating copyrighted content. Look into intellectual property for website(s) & website design for more information. Does a hired hitman recieve immunity if in his contract it says they can not be pursued legally? You have the actues reas and the mens reas. - the act and means to commit an offense. I am surprised you havent been questioned yet...
You know clones are usually designed separately ..... all images are different , all content is also mostly ... but the clone I mean , usually in essence ... . there are hundreds of orkut and youtube or myspace clones all around all with similar look and feel and function .
