Legalities of Incentive Websites?

    Hi,

    With websites like Free XBox 360 or something where you fill out a survey and refer 16 friends (for example) and get a free XBox if that was cloned and you gave out a free piece of software (for example) as a reward for filling out the survery, except you bought the license for it every time would that be illegal, because you're sort of selling copyrighted material, whereas an XBox isn't copyrighted, if that makes sense?!

    If its free, you can give things away as a 'gift'. If you are selling it then you should research in a bit more depth.

    You could give away software licenses although its a bit dodgey as its virtual goods.

    If you are selling the license one time per license, that is usually fine. The game is copyrighted, but you have a license. Unless you have some agreement with the software maker that says the license is not transferrable, you can sell the license.
