Legal Question...

    I have a website with the word Zune in it. Zune is Microsofts soon to be release program to "kill the ipod". My site is about the Zune Player. Since the product is not out on the market yet, could i still get a C & D letter when it does come out? Just curious.

    You can expect everything from Microsoft or any other major compayny.

    I remember something about a legal issue with Nissan, the owner's surname claimed by Nissan Motors whose name was orginally Datsun but today they have the money and the power :rolleyes:

    When you say website do you really mean domain name? If so how long ago was your domain registered? If you registered your domain before Microsoft started using the word as a trademark your domain will qualify as prior art.

    The Nissan example is a poor example because the individual was placing banner ads advertising automobiles on his site, which was supposed to be about his computer business. Had he not placed the automotive ads on his site, he probably would not have lost his case. Basically he lost because he was using the domain name in bad faith.

    In your case you must be careful about the same thing.
