Hi, I would like your opinions on this page I wrote in regards to a notary I sued for negligence and won against. Most of the page are Just the Facts, and excerpts of statements made by the judges from the trial transcripts slamming the notary for his unintelligible work. But I did include some of my opinions on the right side, which are labeled as such. http://bcnotarypublic.bravehost.com/cammack.htm I am thinking about emailing the other party to let them know they can sue him as well, and would likely win based on my case. Sorry, I don't know nuthin' about Canadian law. (And, since IANAL, my knowledge of American law is only mediocre). Your case is interesting - in California I believe that Notaries Public are expressly forbidden from preparing any sort of legal document, so a case like yours would never come up. I suppose your real question is about the legal implications about contacting the other potential plaintiff. I really don't know, but my gut reaction is that you'd be better off simply pointing them towards the information on your web site, rather than saying anything explicit about whether you think they could win a lawsuit. Let their legal representatives make that determination.
Actually I am more concerned about, whether what I have mentioned in my page can cause me problems. Everything is true, but don't want to leave myself open to any legal action. I just want to be extra careful, if there is something that is questionable as to whether it could be actionable, I will remove it. Assuming everything I stated is true and documented, Do you see anything there, that you think could cause me problems? Thanks again
If you are really concerned, you should ask an attorney. I don't know how it is in Canada, but here in the U.S. you can be sued even if you are in the right. The notary you won against might argue that you are hurting his business (I would hope so anyway).
