Contact twitter, for a modification in username if you still don't want to pass account info to filesonic, also options like deactivate, account deletion etc all possible in twitter. but continuing to using their trademarked account is risky.

Just my opinion, final decision always from you.

    Regards

I'm not a lawyer, but I will have our legal team contact you, since you seem to be defiant.

I would have preferred if this was resolved smoothly, but I can guess you're interested in escalating and sticking it in our faces that you're "from the other side of the world". That's unfortunate, because you have a false sense of immunity, when you're clearly infringing on our brand. From now on, I will stop commenting about this issue on DP, as I will place it in the hands of our legal time.

    Thank you.

OK, first of all, did anybody leave a signature on this? Did anybody give you a phone number to call? Did anybody give you anything other than an e-mail address to send over usernames and passwords? Did anybody even give you a name? If not, ask for a person to contact. This could be real, but it could also be fake. Don't listen to everyone telling you to blindly hand over account information.

What I would do: Respond and ask for verification. Ask for a name, phone number, address, and attorney to contact. Contact your own attorney and have them contact FileSonic.com. If it's all real, your attorney will tell you what you should do. DON'T LISTEN TO ANYBODY ON THIS FORUM.

If you're serious, you should've done this in the first place and not come to a forum to "yell" and try to flex muscles. You're making FileSonic look bad. Besides, your site encourages sharing of copyrighted material so you should probably just relax.

Are you also an affiliate of Filesonic. if you are, then you have no choice but to relinquish the same account to them. If you are not working with Filesonic as an affiliate, you can given them a hard time if you want...

okay i will put a query here for OP. The domain filesonic.com was registered in april 2008. have you made the twitter account before april 2008? another this Mr.Filesonic, when did you registered the trademark? before he signed up in twitter by name filesonic or after it?

In case you did afterwards, then please hold whatever you are saying and settle the issue out of court. Pay the champ some amount for the account and get it. Whats the harm? Why are you creating so much issue out of it? Buy it man. If it is your trademark settle it on some amount and buy :)

The OP took a trademark that didn't belong to him and created a Twitter account. He then placed www.filesonic.com as his website url (which wasn't his) and proceed to make a whole bunch of posts, each with a link for files on filesonic.com.

After filesonic.com contacted him, he deleted all this information from the Twitter account. His legal problems don't go away because he deleted the information, he could still be held liable for trademark infringement.

A trademark holder doesn't have to pay anything. The OP is at risk for being sued. He should stop being an ass an turn over the account before he gets sued and risks spending a ton of money in legal fees.

Don't take someone else's trademark and use it unless you have express permission. Legal fees can easily run into tens and hundreds of thousands of dollars. It's not worth the risk.

THANK'S ALL OF YOU FOR YOUR VALUABLE COMMENT. I AM REALLY AFRAID NOW.. I ASKED FILESONIC ABOUT THIS TWITTER ID BEFORE.

    http://forums.digitalpoint.com/showthread.php?t=1834568&page=64

BUT THEY HAVE NO ATTENTION ABOUT THIS TWIITER ID.. OR THEY DON'T ANSWER MY QUESTION. MAY BE THEY WILL GET THIS TWITER ID DIRECTLY FROM TWITTER... I WILL LOST IT... :((

Twitter will not do anything without contacting you first. If you do not comply with them, then they should have there lawyer contact you. Don't be forced to unless you have a lawyer contact you.

I would strongly advise you to read over Twitter's Terms of Service. It looks odd to me as i have never heard of this. I would go through with it and wait until either Twitter or your ISP contact you. They would only send you mail or and email saying that you have to sign it over to them.

As long as you are not saying you are FileSonic then you should be fine in my opinion.

That is just my opinion going by the first post what was made.

    Thanks,

    Michael

In any term, if you feel that you are doing something incorrectly, just top doing it and do take action to repair the damage.

If you feel is incorrect what you had done, don't wait any lawyer to contact you. Fix the issue in the best way as possible.

If you WAIT to be contacted by a lawyer, there could be already some legal charges against you.( who pays the lawyer cost???)

Don't wait, take action...... so you can sleep well without worries...

What a stupid thing to discuss this in public. Now I will never ever use filesonic after reading this topic. (so its good for something after all) Are these guys uzbekistan mafia or so? Who can afford themself a lawyer in the meantime. I bet they do business like this all the way all the time. Is it just because some of you get a dollar from filesonic once in a while, that you let this guy from filesonic threaten your fellow little man, who has a stupid twitter account called filesonic. My god, i shake my head of no no no, what has this world become.

Sorry, have to let is out after reading too much bootlicking comments. j
