You mean not necessarily selling it to the Lavo Club (Tao Group of LV), but rather one of the many celebrity gossip/paparazzi places? In case of a bidding war between those two camps, it could go even higher, I assume. Thanks for your opinion.
Why so low? Your opinion is based only on brand-ability? Did you check the potential market out there, not to mention the caliber of the prime candidate, and not counting someone in the competition of the Lavo club grabbing hold of it, given the current celebrity media frenzy. Thanks.
If the restaurant didn't contact you before they opened, or in the past two years since they opened, it would seem to mean they are not interested in acquiring the domain. Avoid any type of potential trademark infringement, that will just set them up to take the name from you. I like the domain as a four letter domain, better than most. Restaurant hurts not helps, though, as the name as a brand will have competition. I registered this domain in 1998 to go along a company with a name that the 4 initials matched the domain (Latin American Virtual Office). I also registered the company at the same time, so I doubt they could have any way of trademark infringement action. In any case it would be the other way around. The company website is still up, but I'm semi retired from that particular business and when I realized the potential value of a 4-letter domain these days, wanted to take the chance to sell it for something worth letting it go. I've already got a few offers in the $.$$$ range, but I think in this case given the prime potential buyer's profile, the deal should go to 5 figures. If not maybe I'll keep it for another year and it will be worth more then. Wouldn't you agree?
The trademark issue is specific to use, meaning no one can open up a virtual office business and call it for example iLAVO, that would be infringing on you. A bathhouse themed restaurant is not an infringement, nor are the several companies that have trademarked LAVO for cleaning related products. My point was that if you start using the site to take restaurant reservations for another place or do anything to confuse people that your website is related to the restaurant, that is when their lawyers will pounce and basically it will be too expensive for you to mount a defense. The name is a spanish keyword for "to washe" basically, what company would want to own to towash.com in english, then find that company in mexico or spain or any other latin country. That is where your value will come from. Do serious research before approaching any companies, like I said there are a couple trademarks in the US, most of them have expired so you might have an opportunity. You need a client marketing to spanish speaking companies to maybe find a good potential buyer. Remember that the name might be trademarked in other countries, and I believe there is some soap called Lava, issues like that make the waters dangerous as I explained above regarding the restaurant. cerno knows what he is talking about and you should consult an IP attorney over the potential legal issues you may face. I think the first thing they would tell you is to stop posting about hoping to get money from other trademark holders in an unrelated sector to your usage. They could make a bad faith claim and everything you post is fair game. You may have a trademark for a particular usage, but that mark does not extend to any other usage. When you start trying to profit off another usage, you can have huge legal issues and wind up getting sued and/or having your domain taken from you - just look up the trademark infringement cases against Apple Corp and the Beatles - both of which hold trademarks for "Apple".
