if a person places keywords in his navigation menu, let's say 40+ occurrences of his chosen keyword, wouldn't google penalize his site for keyword spamming?

Your navigation menu must be crisp and clear about what it does. Sure you can spam it, but the whole point is to tell the se algo what the page is all about.

its for about 40+ articles, and i was thinking of creating a navigation menu on the side linking to every article. would this help or hurt my seo efforts?

the text in the navigation is very relevant, but if it occurs this many times, would google penalize me? :p

You'd probably be better off having a link to all the articles on your sitemap page. It'd make the home page alot less cluttered aswell.
