Some of you may have heard the initial news, the state of Kentucky seized 141 gambling domains: "Kentucky received court permission to seize 141 gambling Web sites' domain names as it tries to put them out of business there. Gov. Steve Beshear (D) said at a press conference that the gambling-friendly state is taking "unprecedented action" against sites that "siphon off money from regulated and legal games," such as the state lottery and thoroughbred racing. Kentucky has lost "tens of millions" to unlicensed gambling, he said. Franklin County Judge Thomas Wingate ordered the domains transferred to Kentucky, "an important first step" in keeping Kentuckians from accessing the sites and forcing sites to pay damages, Beshear said. " ***UPDATE: After an appeal, a higher Kentucky court upheld the ruling. So far, I've heard that registrars Moniker, Enom and GoDaddy have complied without a fight and transferred the domains to the state of Kentucky. What does this mean? IF this ruling holds up, other states could follow suit and prosecute any domain owner or registrar that breaks their own state laws. Regardless of where you live or operate your business, if your domain is against STATE law, it can be taken away from you. Why stop at gambling? Adult domains can be considered obscene, Pharmacy sites can be considered unlicensed... ANY business that breaks local state laws can be a target. Even if this doesn't hold up in court, your domain can be ceased while they figure it out in the courts. Time to let the registrars know how you feel about this! source
