Totally off-topic, but I just found out that an album that I produced (I wasn't in the band) 5 years ago is in the iTunes music store. Not sure how it got in there since I own the label it was produced under... but interesting none the less. If you have iTunes, go to the music store section, and search for "dama"... the 2000 A.D. album is the one. If you don't have iTunes you can get it at http://www.apple.com/itunes/ (for Mac and Windows). It's the best MP3 player out there, so you should have it anyway. I wonder who is getting the money when someone buys it... not me, and not the band members. Weird.
That is really freakin' weird....How can iTunes do that without paying the record label or the band?! I just talked to the lead singer of Dama and he said, "Strange...maybe we can sue and get money to record our next album!!"...haha.

Some old friends of mine that I grew up with had the same problem, they won their case against Atlantic Records, every member of the band happens to be worth Billions, they have the best lawyer, his name is on the documents. I'd look into it shawn - even if it isnt being heavily downloaded, I'd still think you shouldn't let them get away with having it on there.
Part of the law states that (at least the trademark laws do) if you do not contest the illegal use of the property, then it is subject to become public domain, copyright laws may not have this requirement, so you may have a strong case. Contact RIAA and they should be able to guide you as to what recourse you have to protect your rights.
The funny thing about the music business is that the product is very much the same as the software business. You buy hardware, but unless you have the software to put in the hardware you hear no music. So Apple is stealing your software
Funny that Apple has tunes to download without permission of the owners of the songs, sort of like what Napster was doing before they got shut down. Some old story, sell it today, keep the money, if someone wants to fight you and file suit let them do it, if they have a case maybe we pay, if they never sue us we get to keep the money

You should file a lawsuit for the principal of making music available without the rights of the owner being addressed. File a 100 Million dollar lawsuit, get it in the paper and you could always settle for much less. You can get some great advertisement from it (if the band was any good.) LOL Apple expects lawsuits on this, that is just part of doing business now adays. Look up M Att E l and Lawsuits, that is where they make a lot of money. I worked for a company that they sued even though they gave their product to them. Went from 500,000 down to a 2,000 settlement! It was sort of funny.
