Issue from my friend

    Hi Guys,

    I was talking to one of my friends last night and he was telling me how he was ripped off by a web group for a clan site, I wont tell the name of this group but they are huge in the Gaming community.

    They charged him $3500 to create a clan site with a cms, now when I heard this I could not beleive he had done it. I did not know him then and he would of hired me to do it. But anyway, its 7 months now and he still has not been given the site after dealy after delay.

    I was wondering what action he can take to reclaim the money the transaction was through paypal btw.

    Chances are it is probably too late to do anything, but have him take a look at the contract. And then send everything over to Paypal to see if he can re-claim his money.

    Sometimes, just a letter from an attorney will help. Jeffrey Cohen comes to mind for that

    Thanks for that very helpful link.

    Anyway yes as above said it is probably to late and as it is a none tangible good you will probably be very limited as to what you can do.

    Has he tried contacting them was there a contract agreement?? what was the deadline set for the site to be complete??

    And yes that is way to much to pay :O

    You can seek legal actions. Contact an attorney or start a small claims complaint.

    If you are thinking about legal small claims actions check out legalwebmd.com or legalzoom.com (however I dont think legalzoom does complete filing).

    Would he be able to do a small claims if one is in uk and other is in usa.

    Small claims is only the USA, we have the Small Track of the County Court in England/ Wales and the Sheriff Court in Scotland.

    He would need to read the contract he signed as any normal contract will stipulate which legal system binds the contract.

    At the end of the day the contract and any discussions before hand bind what must be done and when. Obviously work on different scales as $3500 isnt that bad a price (given the weak dollar) for this type of site. 7 months? well even that depends on what was agreed and discussed. If nothing about timescales is mentioned either precontract or in the contract then basically he has got hardly a leg to stand on as you cannot make something conditional after both sides have already agreed the terms.
