    They say you don't have to be black to use the site so I guess aside arguably poor taste, it's not against the TOS.

    It depends on the tone of the site. From what I can tell, it's a "for black people" version of Myspace (or somesuch) and since it's universally acknowledge that only blacks can use "nigger" or a variation of the word, then this isn't hate speech or racist.
