is this wrong

I did a search for a keyword and I found that a site ranking no 3 was
actually just a redirect to another site
but it was ranking that high because he used frames to copy the
real site so google sees it as exactly the same thing and the domain
names are similar.
My question is does this amount to cloaking, in that google thinks it
is the real site whereas it is just a framed re-direct to the real site
and also is it wrong

 

Its wrong and im sure it will be caught soon....I wonder how long its been like that
